תנאי שימוש במאגרי הדימויים א. הכניסה למערכת מאגרי הדימויים כמו גם העיון בחומרים המוצגים בה הינם ללא תמורה. כל אדם יוכל לפעול במערכת בכפוף לתנאי השימוש, והוא ייקרא להלן, לשם הקיצור: "המשתמש". ב. תנאי מסמך זה חלים על כל דרכי השימוש, באתר ו/או במערכת ו/או במאגר ו/או בדימוי, כולם או חלקם, ובין היתר, באמצעות מחשב, מכשיר סלולארי וכל אביזר אחר שהוא. ג. השירות למשתמש במאגרי הדימויים ו/או באתר, עומד לרשות המשתמש (בכפוף להסכמת המשתמש לתנאי מסמך זה) כמות שהוא (AS IS) והוא כפוף לשיקול דעת בצלאל להפסיק השירות ו/או להסיר המאגר כולו או חלקו או כל דימוי, במלואו או בחלקו, בכל עת ומכל סיבה שהיא, ללא מתן הודעה מראש. ד. משתמש לא מזוהה מחוץ לבצלאל, רשאי לעיין במאגר ארכיון בצלאל. משתמש מזוהה (שנכנס למערכת עם שם משתמש וסיסמא שהונפקו לו כדין על ידי בצלאל) רשאי לעיין במאגר ארכיון בצלאל, מאגר חומרי הוראה ובאוספים חיצוניים. ה. תנאי מוקדם בלתי מותנה - בשימוש במערכת, כולה או חלקה, מביע המשתמש הסכמתו לתנאים הנקובים לעיל ולהלן במסמך זה. הסכמה זו מהווה תנאי מוקדם לשימושים האמורים, ולפיכך מתבקשת קריאת מסמך זה בעיון, שכן השימוש במערכת ו/או במאגר מסויים ו/או בדימוי או חלקים מאלו, ייחשב כהסכמה בלתי מותנית לכל התנאים הנקובים במסמך זה. ו. קניין רוחני - זכויות הקניין הרוחני, לרבות זכויות היוצרים בדימויים ו/או כל זכות אחרת על יצירה איזו שהיא הנמצאת במאגר מתוך המערכת, הינם רכוש בצלאל ו/או רכוש בעלי הזכויות בהם אשר התירו לבצלאל רשות שימוש בלעדית בו. בהתאם לכך, אין להעתיק, להפיץ, לפרסם, להציג בפומבי, למסור לצד שלישי, לשנות, לעבד, לתרגם, ליצר יצירות נגזרות, למכור, להשכיר, או לעשות כל שימוש, בין מסחרי ובין שאינו מסחרי, בכל הנ"ל, בכל דרך או אמצעי, בין אם אלקטרוניים, מכאניים, אופטיים, אמצעי צילום או הקלטה, או בכל אמצעי ודרך אחרים, בלא קבלת הסכמתה המפורשת ובכתב של בצלאל ובתנאים שתקבע. אין באמור לעיל בכדי לפגוע בזכויותיהם של צדדים שלישיים בעלי הזכויות בדימויים המופיעים במאגר. ז. חוק זכויות יוצרים (להלן: "החוק") קובע מהם הכללים לשימוש ביצירות, לרבות צילומים, תמונות, ציורים, כרזות וכיוב' חומרים המוגנים בזכויות יוצרים. בהתאם לחוק, לא ניתן לעשות שימוש בדימוי מתוך מאגר כלשהו הכלול במערכת, אלא למטרת לימוד עצמי, הוראה או מחקר. משתמש שיעשה שימוש בצילום, העתק, או כל יצירה אחרת שבמאגר, למטרות החורגות מהשימושים המותרים לפי חוק זכויות יוצרים, עלול להיות חייב בגין הפרת זכויות יוצרים כלפי בצלאל ו/או היוצר ו/או בעל האוסף ו/או כל בעל זכויות . ח. מבלי לגרוע מהאמור לעיל, ולמען הסר ספקות שימוש בדימוי כלשהו מתוך ספר המאה של בצלאל, שלא למטרות מחקר או לימודים יחשבו גם כהפרת תנאי השימוש באתר זה. ט. העדר אחריות - בצלאל אינה מתחייבת לתקינות ו/או שלמות ו/או בהירות הדימויים שבאתר ו/או נכונות הנתונים המופיעים במערכת, ובשום מקרה היא לא תישא באחריות כלשהי לדימויים ו/או לתוכן המופיע במערכת ולא תפצה ו/או תשפה את המשתמשים באתר בגין כל נזק ו/או הוצאה ו/או הפסד ו/או טעות או הטעיה שנגרמו להם,לא במישרין ולא בעקיפין, בגין השימוש במערכת ו/או במאגר ו/או בדימוי, כולם או חלקם. י. השימוש באתר ו/או במערכת ו/או במאגר ו/או בדימוי, כולם או חלקם, הוא באחריותו הבלעדית של המשתמש. יא. לבצלאל הזכות לשנות, בכל עת, כל אחד מהתנאים הנוגעים לשימוש באתר ו/או במערכת ו/או במאגר ו/או בדימוי מסויים וכל שינוי שכזה יהא תקף עם פרסומו באתר, או בכל אמצעי אחר שעליו תחליט. יב. פיצוי – שיפוי - המשתמש באתר או בדימוי מהמאגר או בכל יצירה שבמאגר או חלק ממנה, מתחייב לפצות או לשפות (לפי העניין), את בצלאל וכל מי מטעמה בגין כל תביעה שתוגש, או הוצאה שתיגרם לבצלאל או למי מטעמה, בשל שימוש כאמור של המשתמש, או בגין פעולה מפעולותיו, או מחדל ממחדליו הקשורים לשימושו באתר בכל דרך שהיא. Image Banks/Databases – Terms of Use a. Accessing the image bank/database system, as well as reviewing the materials presented therein, are free of charge. Any person may operate within the system subject to the Terms of Use. Any such person will hereinafter be referred to as "The User" in abbreviation. b. The terms prescribed by this document apply to all ways of use of the website and/or the system and/or the bank/database and/or the image, jointly or severally, among other things, using a computer, a cellular instrument and any other device. c. The service offered to the user of the image databases and/or the website is available to the user (subject to the user's acceptance of the Terms prescribed by this document) as is, and it will be subject to the judgment of the Bezalel Academy to terminate the service and/or to remove the database, in whole or in part, or any image, in whole or in part, at any time and for any reason whatsoever, without prior notice. d. Any unidentified user from outside the Bezalel Academy may review the Bezalel archive database. Any identified user (a user who has accessed the system using a user name and password lawfully provided to him by the Bezalel Academy) may review the Bezalel archive database, the teaching material database and the external collections. e. Unconditioned Prerequisite: by using the system, in whole or in part, the user expresses his/her acceptance of the terms outlined in this document. Such acceptance constitutes a prerequisite for the aforesaid uses, and, therefore, this document should be read carefully, as the use of the system and/or a specific database and/or an image or any part of the above shall be regarded as unconditioned acceptance of all of the terms prescribed in this document. f. Intellectual Property: the intellectual property rights, including copyrights of the images and/or any other right of any creation stored in any of the databases of the system are the property of the Bezalel Academy and/or the property of the owners of the rights thereto who had provided the Bezalel Academy with the exclusive permission for the use thereof. Accordingly, all of the above must not be copied, distributed, published, displayed in public, passed to a third party, altered, processed, translated, used to produce derivative creations, sold, leased, or used, either commercially or non-commercially, in any way or through any means, be it electronic, mechanical, optical, a photography or recording device, or in any other way or through any other means, without obtaining the express written approval of the Bezalel Academy and subject to the terms it will prescribe. The above shall have no prejudice on the rights of the third parties who own the rights to the images stored in the database. g. The Copyright Law, 2007 (hereinafter "The Law") sets forth the rules for the use of creations, including photographs, pictures, paintings, posters and so forth, materials protected by copyrights. According to the Law, no image from any database included in the system may be used except for the purpose of self learning, teaching or research. Any user using a photograph, a copy or any other creation in the database for purposes digressing from the uses allowed in accordance with the Copyright Law could be held liable for violation of copyrights toward the Bezalel Academy and/or the creative artist and/or the collection owner and/or any owner of rights. h. Without prejudice to the above and in order to quell any doubts, the use of any image from the Bezalel Academy Centennial Book (The "100 Book") for purposes other than research or study shall also be regarded as a violation of the Terms of Use for this website. i. Waiver of Responsibility: the Bezalel Academy is under no obligation for the good working order and/or integrity and/or clarity of the images in the website and/or for the correctness of the data indicated in the system, and under no circumstances shall bear any responsibility for images and/or contents stored in the system, nor shall it compensate and/or indemnify the users of the website for any damage and/or expense and/or loss and/or error or misguidance caused to them, either directly or indirectly, pursuant to the use of the system and/or the bank/database and or the image, jointly or severally. j. The use of the website and/or the system and/or the database and/or the image, jointly or severally, is the exclusive responsibility of the user. k. The Bezalel Academy has the right to revise, at any time, any of the terms pertaining to the use of the website and/or the system and/or the database and/or a specific image and any such revision shall become valid upon having been announced through the website or through any other means the Academy may decide upon. l. Compensation – Indemnification: the user of the website or the image from the database or any creation from the database or any part thereof hereby undertakes to compensate or indemnify (as the case may be) the Bezalel Academy and any party on its behalf for any claim filed, or for any expense incurred by the Bezalel Academy and any party on its behalf, pursuant to such use by the user, or for any act of his/her activities or for any omission of his/her omissions associated with his/her use of the website in any way.
